A MESSAGE FOR DEMOCRATS TO MOVE THE NEEDLE
Nothing has contributed more to the erosion of our democracy than the 6-3 decision that presidents have absolute immunity for acts committed as president within their core constitutional purview. This is the fundamental game changing issue that the democrats must address once they gain conrol of
the House, and the Senate, if they win the midterm elections this year.
These six Justices showed total indifference to Stare Decisis. (adhering to precedent)
After fifty years of it being in place they overturned Roe V Wade. That actually backfired against the Republicans in the voting booths, by becoming a voter generating windfall for Democrats in subsequent elections. Nevertheless, the Roe V Wade voter reservoir remains in place and continues to show up for democrats in elections. Voters in Maine are being reminded of Susan Collins’ 2018 vote to confirm Supreme Court Justice Brett Kavanaugh, who four years later joined a 5-4 majority to overturn Roe v. Wade the landmark abortion rights case. However, it’s still a ruling in place adversely impacting women’s reproductive health throughout the nation.and Democrats are making her vote a major issue in the upcoming midterm elections.
ANOTHER SUPREME COURT NAIL IN DEMORACY’S COFFIN
The Citizen United ruling got this autocractic ball rolling that is now practically a fait acompli. Fast forward to the recent Supreme Court immunity ruling. This would seem to be a much bigger and compelling voter generating issue for the democrats as compared to Roe
V Wade. Because the immunity ruling rewrites the constitution allowing for Presidential immunity that has never been in the constitution since it was written, violating the basic rule of no one is above the law. This shows these six renegade justices have dropped all pretenses of adhering to their oath of office to “support and defend the constitution against all enemies foreign and domestic.” Instead, these six Justices have become the unapologetic domestic enemies they swore to defend against.
All six of these Supreme Court Justices, from the Chief Justice on down, have betrayed their oaths of office in pursuit of their anti-democracy autocratic agenda, and their transparent attempt to accommodate Donald Trump and move the nation from a democracy to an autocracy.
Plus, two of the six, Thomas and Alito are known for accepting substantial undeclared
gifts exceeding in value upwards of six figures. These gold digging twins, also refuse to recuse themselves while having obvious conflicts of interest in cases before the court. Plus, these same two Justices have spouses who supported the Jan 6 insurrection. Marquette Law School Poll shows the Supreme Court is at an all time low in public approval. That includes Democrats, Independents and who knows how many Republicans?
These anti-democracy rulings, despite being unpopular, violate the constitution, and
are key in dismantling our democracy, and remain solidly in place. They’ve already been used as the basis for a dismissal by Judge Cannon. Not to mention so many others in the dockets waiting for their shot at gaining dismissals for their insurrection activities and other charges in waiting. Oops Trump just took care of that with his blanket pardons of his secret police that he’s now trying to pay with a slush fund.
PUTTING ALL ARGUMENTS AGAINST PACKING THE COURT TO REST WITH LOGIC AND COMMON SENSE
Jamis Gorelick, former Deputy Attorney General said on MSNBC the only
solution is time.“If you pack the court, the next President will pack it more.” In other words, let’s don’t do anything because if we solve this problem now they will just create the same problem later. That’s self-defeating illogical reasoning is not peculiar to Ms Gorelick. I believe President Biden was also a proponent of that thinking. Any reasoning that does not dictate fixing the problem when the opportunity presents itself misses the obvious solution.
Also that reasoning doesn’t seem to have thought throughsome obvious remedies, chief among them being stricter gift acceptance rules, and automatic recusal requirements.This is not as much about conservative versus liberal, democrat versus republican judges problem. This is ethical versus unethical individuals. There are those on the court who are receiving gifts from donors who have cases before the courts. Nevertheless, you don’t just pack the court with ethical judges, you fix the court with rules of ethics that all justices must follow that include automatic dismissal when violated. There are a couple of justices that would be immediately disqualified when the new rules are enacted and retroactively applied.The fixing should include clear conflicts of interest recusal rules.
Adding more Justices to the present Supreme Court is the solution. In the mean time, we can’t afford to wait for these renegade Justices to die or retire even while their anti-constitutional rulings remain in place and they remain unchecked ready to further violate their oaths and the constitution. The main point is their rulings have proven to be unpopular, which means that now that the public has gotten a taste of the results of their decisions including the Latina’s getting a sample of ICE’s gestapo tactics that the Republicans insists on maintaining, it may be a while before people want to experience this Republican menu again.
MITCH McCONNELL HAS SET THE PRECEDENT FOR WITHHOLDING SENATE SEATS OPEN
Actually the first thing for Democrats to do when they gain control of the house and Senate, is to introduce ethics rules for the justices that all federal judges must adhere to, punishable by immediate dismissal. That can be done with success of the democrats gaining the house and Senate during this midterm. As for allowing the republican President to select replacements, Mitch McConnell has set the precedent for waiting for the right President to appoint the next Justices when you have the Senate majority. Leave the court at seven until
a democratic President can add four true to the constitution and beholden to their oaths,’ Justices to the Supreme Court giving them a seven to six constitution protection majority. That will neutralize the existing corrupt three, Kavenaugh, Thomas, and Alito. Then you immediately introduce reforms while you have the same majority in the House, Senate, Presidency that allows you to add Justices.
That prevents the same offenses from occurring plus enforcement penalties will be introduced disqualifying obvious violators. You don’t just pack it. You “Add Justices and fix it,” which is the only choice left, other than leaving these six renegade Justices free to continue their anti-democracy agenda, and destroy the American democracy most of us love, which is clearly out of the question.
As for reluctance to tamper with the institution, that ship has long since sailed. The Republicans and Trump have mauled the institutions starting with the supreme court and started during Gore versus Bush. The constitution is being shredded by these six renegade Justices, which is the foundation for the whole operation and the ultimate item not to be be violated. Let’s keep our priorities in order.
Here are a few of the fixes that will be addressed and that the voters should be made aware of to better appreciate what can be achieved with the democrats being in the majority. (1) A code of conduct and ethics will be adopted that the Supreme court justices will be required to follow like all federal judges. (2) Roe V Wade will be restored. (3) Citizens United will be fixed. No more secret money in politics, (4) Gerrymandering that was allowed will be reversed. (5 )The rule of law will be restored and the constitution will be re-established as our guiding principle that no man is above the law. 
We can’t leave the main arrow in the quiver. There is not much we can thank the leader of the senate for, who delivered a scathing speech immediately after the attack of the insurrectionist on the Capital. He declared Trump”practically and morally responsible” but still voted to acquit Trump in his second impeachment trial. At least Mitch McConnell has given Democrats the Blue Print and a tutorial for keeping a seat open when you have the majority in the senate and the President is in the other party. Thanks Mitch!
